Well he can argue that his actions were taken on behalf of the club and in the club's interests...
...but that's not really important. With Bates' rather convoluted ownership arrangements it would probably be impossible to know who really pays for what, and there won't be anyone holding him to account no matter what he does.
Do you honestly believe Bates will be digging into his own pocket to settle the costs?

More than likely he'll have his insurance paying this off, or finding some tax deductable way
Do you really think he's going to get LUAFC (or whatever the company is now called) to pay his legal fees? Im fairly certain that thats just plain illegal

Only if it's transparent. He was able to buy the club from himself and get rid of the debts during the whole administration scam, which only goes to show that Bates has had a lifetime of learning how to obfuscate financial arrangements.
Of course, you are probably right and the payments will be made through insurance. Then again, who will have to bear the resulting increase in insurance premiums? (...and which insurer is stupid enough to cover Bates against saying something stupid and offending people? That's a bit like insuring someone against there being daylight tomorrow.)

Ken has now been refused leave to appeal:
Leeds United chairman Ken Bates has been refused leave to appeal his libel case defeat against former Elland Road director Melvyn Levi.
The Court of Appeal this week rejected the application against Mr Levi's victory in the summer.
The businessman was awarded £50,000 in libel damages against Mr Bates at London's High Court.
