someone somewhere must have known about the L2 option and not a single person said it. No-one at Leeds, no-one at the FL and more unbelievably no-one in the press.
Was it true?
Having been relegated already (luton) it will be interesting to see if they get a 15 point deduction next season. Being in L2 will Rotherham automatically get a 15 point deduction and what is the point of Bournemouth trying to avoid relagation today as that would be better than a 15 point deduction next season.
Ho, Ho I think I have just found another loophole.

None of them have come out of admin yet though have they?
they deduction or relegation will come after they come out without a CVA in place

As the season is now over for the teams in question and the 10 points for going into admin have already been deducted, it would seem to me that the 15 points will be deducted when they leave administration without the CVA in place - presumably imposed at the start of the 2008/09 season then. |

in the cold light of day, there is another way of looking at this.
KB asked for exceptional circumstances and he got them. The FL giving us -15pts instead of L2 status. The chairmans all voted for it, albeit altruistically, believing that
a) Leeds would never be able to turn it around
b) should they ever be in the situation that Leeds were, in -15 was better than L2 (esp from CCC)
So they actually did us a favour and KB used it by not telling the whole truth, but then the FL didn't either and thats where they went wrong. Can't believe that no-one actually pointed out that the -15pts were instead of L2 status!
If it had been we would all have hated KB (more than we already do in some cases) and not the FL and gawd knows where we would be. Instead leeds used it as an us against the world and here we are in the playoffs, thinking we are lucky b@stards and there's only one way to go.
Come on Leeds.

Rubbish! Of course there should have been an appeal. Why? Two simple reasons
1. There was and still is NO statute in the FL rules to allow a decision to relegate a team 2 divisions, or more precisely, to be offered the "Golden share" in return for voluntarily dropping a division
2. Common law states that you can NOT blackmail anyone with two different penalties. Eg. A judge can not say to a defendant you either take the massive fine or I bin your arse. The reason being is that by having someone choose, "implies" they are accepting guilt
I would have appealed on Point 2 alone

You've never had a speeding fine or a parking ticket over here have you?
If you accept your "guilt" the punishment dished out is less severe than if you unsuccesfully challenge the allegation:
1. Get a parking ticket and it's £40. Pay within 14 days and the cost is halved to £20. Appeal against the ticket unsuccessfully and you have to pay the full £40, regardless.
2. Get caught speeding (either by traffic cop, or roadside camera) and it's a "Fixed Penalty Notice" with a £60 fine and 3 points on your licence (12 points in 3 years - I think - and you're banned from driving). Decide to go to court and unless you're a Premiership footballer you will be found guilty (your word versus plod / plod machinery) and it's a minimum fine of £60, plus court costs for both sides, plus between 3 and 6 points on your licence depending on the opinion the magistrate forms of you as you stand in the dock.
Just two examples in English law where having the temerity to appeal a decision will leave you in a worse position than accepting it. |
